GENERAL TERMS are:
ALL PROPERTY IS SOLD' AS-IS,' and ALL SALES ARE FINAL: Taylor Auction & Realty, Inc. has put forth every effort in preparing the catalog for this auction to provide accurate descriptions.
Please review the description of the lot you are bidding on. Pictures may depict more than what is offered in the lot. Please do not assume a lot consists of more than one item unless the description of that specific lot says so. You are bidding on what is described, NOT the picture. Click on the photo for each lot to view more pictures and information. Some lots may have as many as five or more photos; images can be enlarged by clicking on them again.
Taylor Auction & Realty, Inc. may attempt to describe the merchandise in its advertising, but makes no representations. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. In no event shall Taylor Auction & Realty, Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. The bidder shall be the sole judge of value. Taylor Auction & Realty, Inc. will not be responsible for any errors or omissions in the merchandise description. The bidder agrees that everything is sold as is and that they may not return any item they purchase.
Payment Details:
All accounts must be settled after the auction. We request payment be made in full at the end of the auction or on removal day(s). We accept Cashier's Checks, Wire transfers, Visa, American Express, MasterCard, and Discover. No credit card chargebacks are allowed. Bidders are charged an 18% Buyers' Fee; Buyer’s Fee reduced by 3% to 15% buyer’s premium if customer pays by Cash, Check, Wire Transfer, Zelle, or Venmo. MS 7% SALES TAX is CHARGED, UNLESS a resale tax permit number is on file with Taylor Auction & Realty, Inc. Checks will be accepted at the Auctioneer's discretion. Bidders must send Resale tax permits before the auction closes.
Photo Identification: If our staff is unaware of the registered buyer's photo identification, the buyer must present it during the payment process. The buyer's credit card must be issued in the buyer's name or the business name for which the purchase is being made. Electronic bank transfers for the final payment of purchases must originate from an account of the registered buyer or the company the buyer represents. The transfer must include the bidder number and the invoice number.
DECLINED CREDIT CARDS, RETURNED CHECKS, or NON-PAYMENT:
Any bidders with credit cards declined on reconciliation day or who provide an insufficient check are blocked from our system.
RETURN CHECK POLICY:
If Taylor Auction & Realty, Inc. receives a returned check, the buyer agrees to pay a $30 returned check fee. Additionally, the buyer agrees to pay via certified funds for the entirety of the returned check, plus a $30 fee, or return the merchandise. If the buyer returns the merchandise, the difference in the amount owed after it is sold, plus any other expenses incurred for the resale of the items, is the responsibility of the defunct bidder.
REMOVAL POLICY:
Buyers must arrange for removal before the end of the sale. The buyer is responsible for checking the entire lot before removing it from the premises in the presence of a Taylor Auction & Realty, Inc. employee. We will not be held responsible for damaged or missing pieces once the package is in the bidder's possession. It is your responsibility to review your purchases and their condition. Our staff is limited. Therefore, when purchasing large items, please bring sufficient assistance. Our team is here to assist you and all other purchasers in locating items, but we are not responsible for transporting or loading them.
ITEMS NOT PICKED UP:
Any item not paid for and removed on the designated days will automatically be charged to your credit card. Please don't hesitate to contact us if you are unable to pay and pick up on time. The items will be held only for five days. If items are not picked up by the agreed-upon day after contact or within the five days allowed, the items will become the sole property of Taylor Auction & Realty, Inc. Additionally, the buyer may be blocked (denied bidding privileges) from our system for non-compliance. Black-flagged means you ARE prohibited from bidding with other MarkNet Alliance companies.
ANY ITEM PURCHASED AND NOT PICKED UP WITHIN 30 DAYS AFTER PAYMENT WILL BE SUBJECT TO A $10.00 PER DAY STORAGE FEE AND WILL BE SOLD AFTER 45 DAYS FOR THE STORAGE FEES DUE.
BIDDING TERMS AND BID ACCEPTANCE: All bids are subject to acceptance by the AUCTIONEER/AUCTION COMPANY.
Registration: All bidders must provide their name, address, daytime phone number or cell number, and email address. Credit card and driver's license information are also required upon registration. Good communication between Taylor Auction & Realty, Inc. and the bidders throughout transactions is pertinent. Our firm will verify each bidder's identity. Bidding rights are provisional; if complete verification is impossible, Taylor Auction & Realty, Inc. reserves the right to reject the registration, and bidding activity will be terminated.
Our online auctions move quickly! If you are interested in bidding, please bid promptly, especially near the close of the bidding time. The bidding software will notify bidders by email when they are outbid. Bidders can check if they have been outbid by refreshing the individual lot information or the entire screen.
Due to varying internet connections and speeds, please place a maximum bid or continuously monitor the auction as it closes. Email notifications may occasionally be delayed. You should monitor the auction at the extended bidding time session to ensure you are the high bidder.
By placing a bid, you agree to all of the terms and conditions set forth by each auction company and expressly acknowledge and affirm that you have read and are familiar with the terms and conditions of each auction company as well as the terms and conditions of each auction. The Auctioneer/Auction Company reserves the sole discretion to advance the bidding and may reject any suspicious bids that may harm the auction, including but not limited to minimal suspicious and suspect advances. The Auctioneer shall have sole discretion in determining the successful bidder in the event of a bidding dispute. You acknowledge that your bid is a legally binding offer to purchase the item or property being auctioned by placing a bid. Bids cannot be canceled.
Taylor Auction & Realty, Inc. reserves the right to withdraw or re-catalog items in this auction, split or combine lots, add minimum bids, or reserve prices. In addition, at the Auctioneer's discretion, the right to cancel, suspend, extend, or reschedule an individual item and auction event, and change the auction closing times, inspection times, or reschedule removal times.
Auction company employees may bid on auction items for personal consumption. Winning bidders are notified by email when all auction items have closed. Bidders are responsible for checking their email to receive notification that they have won a lot(s).
Reserve Not Met Statement: A reserve not met statement is placed on lots that have a reserve. When the reserve is met, the statement will disappear. After the auction closes, bidders may call the office to discuss the reserve, and negotiations can be discussed.
STAGGERED ENDING:
This auction utilizes a staggered end time, with lots ending every 5 minutes. Lots will remain open as long as there is bidding activity.
EXTENDED BIDDING:
Our auctions use the Auto-Extend feature. The basic rule is that there must be a minimum of 5 minutes for a bidder to react to a bid. If a bid is placed within the final 5 minutes for an item, the ending time is automatically extended to allow for a 5-minute reaction time. If another bid is received during that 'extended time,' the ending time is extended by five additional minutes for each extension. Extended bidding continues and repeats until no more bids are submitted. This 'Auto-Extend' feature ensures a fair bidding process for all bidders, allowing them to respond to any last-minute snipe bid(s). Items are Auto-extended ONLY if a bid is placed within 5 minutes of the scheduled closing time.
MAX BIDS:
Internet bidders who want to ensure their bids are acknowledged should use the maximum bid feature. When you bid your max, the current bid price does not automatically increase to your max bid. Instead, someone else's bid will increase the current price, and the computer will automatically bid to your maximum in the specified increments.
REFRESH YOUR SCREEN:
The screen should automatically update. However, refreshing your screen will reset the catalog, refresh the whole page, and eliminate closed lots. Also, click "Exclude Closed Lots to remove closed lots that take up page space.
TECHNICAL SOFTWARE ISSUES: NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR THE AUCTION COMPANY SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Taylor Auction & Realty, Inc. provides online bidding to bidders. The bidder acknowledges and understands that internet service may not function correctly at times during the bidding process. Under no circumstances shall the bidder have any claim against Taylor Auction & Realty, Inc. or any other party if the internet service fails to function correctly. Taylor Auction & Realty, Inc. will not be responsible for missed bids from any source.
Time Increase or Decrease:
In the event of technical difficulties related to the internet service, software, or any other online auction-related technologies, Taylor Auction & Realty, Inc. reserves the right to extend bidding, continue bidding, close bidding, or adjust the extended time amount at the end of the auction.
SOLE AND EXCLUSIVE VENUE & JURISDICTION OF ALL DISPUTES:
Any claims, including debt collection and all other disputes of any kind, nature, or character whatsoever arising from this auction sale, shall be brought to the appropriate court of Grenada County, Mississippi, and shall be governed by the laws of the State of Mississippi; Seller, Bidder, and Buyer each individually and collectively by participating in the auction conducted by Taylor Auction & Realty, Inc. do irrevocably agree to submit themselves and any claims to the jurisdiction and venue of the courts of Grenada County, Mississippi, and the laws of the State of Mississippi, which shall be the sole venue and jurisdiction for the resolution of any claims between them and Taylor Auction and Realty, Inc. regardless of the nature or location of the property sold/purchased or the physical location of the auction. The successful purchaser agrees to pay all reasonable attorney fees and costs incurred by the Auction Company, the seller, and their servants, agents, or employees in the commencement or defense of any actions and the collection of any obligations hereunder. The purchaser agrees that a fee of 2% per month will be added to any unpaid balance due to the Auction Company, as well as any other costs or losses incurred by the purchaser's failure to adhere to these terms.
HOLD HARMLESS:
Buyer and bidder agree that Taylor Auction and Realty, Inc. is a representative of the seller and agrees to hold harmless and indemnify Taylor Auction & Realty, Inc. and its Agents, Owners, Directors, Employees, and Representatives from claims, demands, expenses, and damages which bidder/buyer may claim on account of or in any way growing out of the said auction and to look solely to the seller for any remedy demanded.
Bidder Acknowledgment:
Bidder acknowledges that no relationship of any nature or type, agent, employee, independent contractor, or otherwise is created between the bidder and the Auctioneer, affiliated auction companies, affiliated software companies, and or any agent or employee of the same by the bidder's participation in this auction. The bidder acknowledges and agrees that the Auctioneer is acting solely as the seller's agent in this auction.
Bidder Responsibilities:
Bidder responsibilities include, but are not limited to, keeping their username and password confidential, as they are responsible for any activity involving their account. You must obey local, state, and federal laws when using the website. Violations will result in the termination of website use privileges. Auction company employees and auction companies may bid on auctions for absentee bidders or on behalf of interested bidders.
Guaranty Agreement for a Business Entity: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement, guaranteeing payment to Taylor Auction & Realty, Inc. and the completion of the transaction.
Liability Waiver and Release: By agreeing to these terms and bidding on this auction, you voluntarily release, indemnify, defend, and hold Taylor Auction & Realty, Inc. and Seller and their respective agents and employees (each a "Released Party") from any liabilities, claims, losses, causes of action or expense of any kind, including reasonable attorneys' fees, resulting from a Released Party's negligent act or omission, arising out of my participation in and presence whether related to bodily injury, infection due to COVID-19 Virus, property damage, or any other form of injury or loss regarding INSPECTION DAYS AND PAYMENT AND REMOVAL DAYS of my physical items purchased at Taylor Auction and Realty, INC.
